Bora Cards Terms of Service

Welcome to Bora Cards! These Terms of Service (“Terms”) govern your use of our website (www.bora.cards), our products, services, and membership programs, including the Bora Collectors Club and VIP Lounge, operated under the trade name Bora Cards by Bora Concepts, LLC (“we,” “our,” or “us”).
By accessing or using our site, purchasing products, or joining our programs, you agree to be bound by these Terms.
If you do not agree with these Terms, please do not use our website or services.
1. Our Products & Services
Bora Cards offers two distinct product experiences:
A. Exclusive Athlete Collaborations
• Limited-edition card releases created through direct partnerships with athletes.
• These collaborations are designed, produced, and released exclusively by Bora Cards.
• Each athlete drop is limited-run, with no restocks, and may include VIP Lounge early access, exclusive 1/1 cards, and Collectors Club perks.
B. Custom Metal Cards
• Fully customized metal cards, designed and produced by Bora Cards based on individual customer requests.
• These are one-of-one or small-run cards, tailored to customer specifications, including personal artwork, names, images (with appropriate usage rights), and themes.
• Custom metal card orders are non-refundable once production begins. Production timelines will be communicated during the ordering process.
2. Limited Edition Product Sales
A. Limited Print Runs & Drops
• All Exclusive Athlete Collaborations are limited-edition products.
• Once a product is sold out, it will not be restocked.
• Product quantities, drop times, and availability are subject to change at our discretion.
B. No Refunds / All Sales Final
• All sales are final.
• We do not offer refunds or exchanges unless a product is damaged during shipment or there is a fulfillment error.
• Claims for damaged items must be made within 7 days of delivery by contacting founder@bora.cards with your order number and photos.
3. Pre-Orders & Custom Metal Card Orders
A. Pre-Order Policy
• Some athlete collaboration products may be available for pre-order. Estimated shipping dates are provided but are subject to change due to production timelines.
B. Custom Metal Card Orders
• Custom metal card orders are made-to-order and follow a production timeline communicated at the time of ordering.
• Once design approval is confirmed by the customer, orders are non-refundable.
• Customers must have the rights to any content they submit. By placing an order, you confirm you have obtained all necessary permissions for use.
4. Bora Collectors Club
A. Eligibility
• Open to anyone who signs up for SMS text alerts through www.bora.cards or other opt-in forms.
In addition, you agree to our Messaging Terms (https://terms.pscr.pt/legal/shop/akm0z4-a0/terms_of_service) and Messaging Privacy Policy (https://terms.pscr.pt/legal/shop/akm0z4-a0/privacy_policy).
B. Collectors Club Benefits
• Early announcements of card drops and releases
• Access to exclusive giveaways and contests via SMS
• Behind-the-scenes content and first looks
• Participation in the Collectors Leaderboard (coming soon)
C. Collectors Club Terms
• We reserve the right to modify, suspend, or terminate Collectors Club access or benefits at any time.
5. Bora VIP Lounge
A. Eligibility
• Available to members of the Collectors Club who have spent $1,000 or more on purchases from www.bora.cards.
• Spend tracking begins when an account is created and SMS alerts are enabled.
B. VIP Lounge Benefits
• Exclusive 1/1 custom metal cards
• VIP early access to athlete collaborations and limited drops
• Invitations to private events and athlete meet-ups
• Access to exclusive Bora merch and collectibles
• Discounts on future card releases (subject to Bora Cards policies)
C. VIP Lounge Terms
• VIP Lounge membership is non-transferable.
• We reserve the right to modify, suspend, or terminate VIP Lounge benefits at any time.
• VIP status is based on lifetime spend, calculated before taxes, shipping, and discounts.
6. Intellectual Property
All card designs, artwork, product concepts, logos, and other content on www.bora.cards are the exclusive property of Bora Concepts, LLC.
You may not reproduce, distribute, or create derivative works from any Bora Cards content without prior written permission.
For Custom Metal Card orders, customers must own or have secured rights to any images, logos, or likenesses submitted. We reserve the right to reject any request that violates intellectual property rights or is deemed inappropriate.
7. User Conduct
By using our website and services, you agree not to:
• Violate any applicable laws or regulations
• Interfere with or disrupt the security or functionality of the website
• Misuse the Bora Collectors Club or VIP Lounge for unauthorized purposes
8. Privacy Policy
Use of Bora Cards’ website and services is governed by our Privacy Policy, which explains how we collect, use, and protect your personal information.
9. Disclaimers & Limitation of Liability
• We make no guarantees about product descriptions, availability, or delivery times beyond what is stated at purchase.
• We are not liable for delays caused by events beyond our control (e.g., supply chain issues, shipping carrier delays).
• In no event shall Bora Cards or Bora Concepts, LLC be liable for any indirect, incidental, or consequential damages related to the use of our website or products.
10. Governing Law
These Terms are governed by the laws of the State of Washington, and any disputes will be handled in Goldendale, WA, without regard to its conflict of law provisions.
11. Dispute Resolution
Any disputes related to these Terms or the use of www.bora.cards will be resolved through binding arbitration in Goldendale, WA.
By using the site, you waive the right to a jury trial or class action lawsuit.
12. Changes to These Terms
We reserve the right to update or modify these Terms at any time.
Changes take effect immediately upon posting. Continued use of the website constitutes acceptance of those changes.
